Myth #1: This law would stop future tragedies by keeping guns out of the hands of dangerous people.

The Facts: Tragic events are heartbreaking, but this law won’t do more to prevent them. Maine already has tools in place for law enforcement to take action. This new law adds no mental health services, skips due process, and doesn’t target criminal behavior -just accusations.

Myth #2: Only individuals who are serious threats will be impacted by Extreme Risk Protection Orders. 

The Facts: This law would allow anyone: a roommate, ex-partner, or coworker, to make an accusation, triggering a 14-day gun seizure before the accused gets a hearing. It targets people struggling with depression, anxiety, or emotional hardship, not criminals.

Myth #3: This law treats mental health with care and caution.

The Facts: There is no mental health professional involved in the decision. Instead, a judge must decide quickly, often based on fear and vague claims. This will discourage people from seeking help when they need it most.

 

Myth #4: This is just like other “red flag” laws across the country.

The Facts: This law is more extreme. It skips basic safeguards like advance notice, evaluations, or even the right to know what you’re accused of until your property is already taken. It removes constitutional rights first, then holds a hearing later. 

Myth #5: People will have a fair chance to get their firearms back.

The Facts: Once your firearms are taken, you must prove you’re no longer a danger. That’s a high legal bar that many law-abiding citizens can’t meet without an expensive lawyer, and you only get one chance in a year to do so.
